The present general conditions of sale are concluded on the one hand by the company ZAG BIJOUX (the "seller"), with a share capital of €13 500, whose head office is located at 159 rue du Temple, 75003 Paris, registered in the Paris Trade and Companies Register under the number 52099414600014 and managing the website zagbijoux.fr and, on the other hand, by any individual or legal entity (the "Customer") wishing to make a purchase via the website zagbijoux.fr.
The General Terms and Conditions of Sale apply to all product orders placed through the zagbijoux.fr website.
The Customer declares that he/she has read, without restriction or reservation, these General Terms and Conditions of Sale as well as the Privacy Policy, and that he/she has accepted them by ticking the box provided for this purpose before implementing the payment procedure on the zagbijoux.fr website.
Article 1. Purpose
The present sales conditions aim to define the contractual relations between ZAG Bijoux and the Customer, and the applicable conditions to any purchase made through the zagbijoux.fr website. The acquisition of a product through the present website implies the Customer's unreserved acceptance of the present sales conditions, which the Customer acknowledges having read prior to placing an order. Before any transaction, the Customer declares on the one hand that the purchase of products on the website is not directly related to his/her professional activity and is limited to a strictly personal use, and on the other hand, to have the full legal capacity, allowing him/her to commit himself/herself under the present general conditions of sale.
ZAG Bijoux reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its website. Therefore, the applicable conditions will be those in force at the date of the order by the Client.
Article 2. Products
The offered products are those that appear on the ZAG Bijoux website, while stocks last. The company ZAG Bijoux reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (composition, size, color, etc.). The visuals of the natural stone jewellery are as accurate as possible, but as each stone is unique, the colors of the stones may differ slightly from the photos.
The sale of products presented on the zagbijoux.fr website is intended for all Customers residing in the countries of the European Union.
ZAG Bijoux also offers a gift card in the form of a voucher that allows its holder to pay for purchases, in one or more instalments, within the limit of the available balance and its validity date, by supplementing if necessary with another means of payment.
The period of validity is limited to 12 months, starting from the date of purchase.
The remaining balance of the gift card will be visible in the customer's account.
The card cannot be exchanged, taken back, resold, refunded or credited to a bank card or bank account.
Article 3. Prices
The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. ZAG Bijoux reserves the right to modify its prices at any time, it being understood that the price appearing in the catalogue on the day of the order will be the only one applicable to the Client. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total amount of the order.
In mainland France, the Customer will be billed a flat-rate contribution to shipping costs, amounting to €6.00 including VAT for home delivery and €4.50 including VAT for delivery to a relay point. In Europe, these costs will be invoiced at €12.00 including VAT for home delivery.
Standard delivery is free from a purchase of €100 and from a purchase of €60 for delivery to a point-relais (conditions valid in mainland France only).
The delivery costs are €15 including VAT for the DOM-TOM. In addition, the customer may have to pay customs duties or other taxes due when importing the products into the country of delivery.
Article 4. Order and payment terms
Before ordering, the Customer must create an account on the zagbijoux.fr website. At each visit, the Customer, if he/she wishes to order or consult his/her account (status of orders, profile...), must identify himself/herself using his/her information. ZAG Bijoux offers the Customer to order and pay for its products in several steps.
The Customer selects the products he/she wishes to order in the "cart", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the Customer, as well as the name of the carrier.
To finalise the order, the Customer must accept the GTC and the Privacy Policy of the site by ticking the box provided for this purpose and then validate the order by clicking on the "validate order" button.
It is possible to pay by PayPal or credit card.
For payments by credit card, the Customer must be the holder of the credit card used. He/she accesses a dedicated space provided by a banking institution, which ensures the security and registration of the payment order.
It is also possible to pay in 3 instalments free of charge with Klarna: In order to offer you Klarna's payment options, we may need to pass on your personal data, including your contact details and order details, to Klarna so that Klarna can assess whether you are eligible for them and tailor them to your needs. Your personal data transferred will be treated in accordance with Klarna's privacy policy .
In the event that, for any reason whatsoever (opposition, refusal of the issuing centre, etc.), the debit of the sums due by the Client proves impossible, the order will not be recorded by ZAG Bijoux.
Article 5. Reservation of ownership
The company ZAG Bijoux retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.
Article 6. Withdrawal
In accordance with article L121-20 of the French Consumer Code, the Customer has a period of 14 days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for reimbursement without penalty, with the exception of the shipping and return costs, provided that the product has not been worn and that the jewel keeps its small reference tag as well as its original packaging. If the jewel does not have its original packaging (reference tag, plastic, pouch), no refund will be made.
Refunds can only be made to the credit card used for payment.
If a piece of jewellery has been purchased with a discount code, then the refund will take into account the amount paid with this code. The same applies to defective jewellery.
It is not possible to replace or exchange returned products. You will have to place a new order online.
If you wish to cancel your order, please send us an email within one hour of your order to info@zagbijoux.fr specifying your full name and your order number, we will do the necessary.
During the festive season, for all orders placed in December, returns are extended until 10 January.
All returns of jewellery purchased on our website must be made through our service.
The jewellery cannot be dropped off in our ZAG shops or at our resellers.
Article 7. Delivery
Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by La Poste through COLISSIMO, a delivery service with tracking and delivery against signature. Delivery times, 3 to 5 working days, are given as an indication only; if they exceed thirty days from the order, the sales contract may be cancelled and the Customer reimbursed. ZAG Bijoux may provide the Customer with the tracking number of the package by email. The Customer is delivered to his/her home by his/her postman. In case of absence, the Customer will receive a notice of passage from his/her postman, which allows him/her to pick up the ordered products at the nearest post office, during a period indicated by the postal services.
The risks associated with transport are borne by the purchaser from the moment the articles leave the premises of the company ZAG Bijoux.
Delivery times are the sole responsibility of the carriers and ZAG Bijoux cannot be held responsible in the event of non-compliance with delivery times.
The Customer is required to check the condition of the packaging of the goods and its contents upon delivery in the presence of the employee of La Poste or the delivery person. In the case of damage during transport, if the package is damaged, torn or opened, the Customer must refuse the package and note a reservation on the delivery slip, a copy of which he/she must request. This verification is deemed to have been carried out once the Customer, or a person authorised by him/her, has signed the delivery note. Any dispute must be made to the carrier, by registered letter, within three days of delivery. A copy of this letter must be sent to info@zagbijoux.fr.
In the case of loss of the package, an investigation will be opened with the carrier with an identity document as well as a certificate of non-receipt of the package. The order will be sent back, no refund request will be taken into account..
Delivery times may be extended during Christmas and New Year period and during special operations (Black Friday, Valentine's day, Mother's day,…)
If a package is returned to the sender for various reasons (Unclaimed, Incomplete address, ...), ZAG Bijoux will reimburse the Customer's order except for the shipping costs.
Delivery via CHRONOPOST: All orders placed before 8am will be received the next day.
Delivery times are 24-48H working days.
Article 8. Guarantee
Legal Guarantee
All products supplied by ZAG Bijoux benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold online, it can be returned to ZAG Bijoux who will take it back, exchange it or reimburse it.
However, any jewellery offered during a promotional offer will not be exchanged or refunded.
All claims or requests for reimbursement must be made by post to the following address: ZAG Bijoux, 177 rue du Temple, 75003 Paris, FRANCE, within 14 days of delivery.
Refunds can only be made to the credit card used for payment.
Commercial Guarantee
ZAG products only bought on this website are guaranteed for one year against any production defect and on presentation of the invoice.
A return slip will be sent to the billing address given at the time of ordering for the mandatory return of the jewellery.
Defective jewellery will either be repaired or exchanged.
No request for refund on a defective jewel will be made, only a credit note will be proposed to you of the value of the returned jewel, usable on our e-shop.
Once the jewel has been repaired or exchanged, it will be returned to the billing address, except in the case of specific requests.
Defective jewellery that cannot be repaired will be kept by our after-sales service.

Defective products are processed within a minimum of 15 days.
If you have purchased one of our jewels from a physical shop, we do not accept returns directly and only your retailer will be able to process the return of your jewel upon presentation of the sales receipt.
Article 9. Responsability
The company ZAG Bijoux is only bound by an obligation of means in the distance selling process. It cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.
Article 10. Intellectual property
All elements of the zagbijoux.fr website are and remain the exclusive intellectual property of ZAG Bijoux. Nobody is authorized to reproduce, to exploit, or to use in some title that it is, even partially, elements of the site that they are in the form of photo, logo, visual or text. Any simple link or by hypertext is strictly prohibited, except an express written agreement of ZAG Bijoux..
Some products have been registered as designs and are automatically protected by copyright.
The Customer shall refrain from any act of reproduction or use of product models, packaging, photographs, photographic compositions, concepts, product names, texts, illustrations, trademarks or distinctive signs, business secrets, techniques or know-how used by ZAG Bijoux, as well as any act tending to the appropriation of these elements, whether or not they are protected by ZAG Bijoux, by a trademark, a design or a copyright.
Article 11. Personal data
ZAG Bijoux undertakes to preserve the confidentiality of the information provided by the Client, which he/she may be required to transmit for the use of certain services. All information concerning the Customer is subject to the provisions of the law n°78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Applicable law and disputes
In the event of a dispute, the Customer may contact the ZAG Bijoux customer service department by email at : info@zagbijoux.fr.
An amicable solution shall be sought before any legal action is taken. Failing this, all disputes to which this contract may give rise, concerning its validity, interpretation, performance, termination, consequences and consequences, shall be submitted to the competent court in accordance with the rules of jurisdiction of common law..
The General Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
